Terms of Use

It is important that these Terms of Use be read by you so as to clarify the conditions upon which we consent to your use of the Site.

Definitions and interpretations

“We”, “us” and “our” (as the case requires) means Fairhand Visiting Physiotherapists.

“The Site” means fairhand.co.uk.

“our Policies” means the policies and statements relating to Accessibility; Privacy; General Disclaimer; and Medical Disclaimer contained within the Site.

“Visitors” means the users of the Site who visit without transacting business.

“Authorised Customers” means Visitors who register to transact business on the Site making use of the various services offered by us.

“You” means Visitors and Authorised Customers as appropriate.

“Website Owner” means Frances Lamberth of 204 Markfield, Courtwood Lane, Forestdale, Croydon, Surrey  CR0 9HU.

Where a word or phrase within the Terms of Use is preceded by the word “including” or “for example” or the like the same shall be deemed to be followed by the phrase “but without limitation”

Reference to one gender shall where the context requires be deemed to be reference to any other gender.

References to the singular shall be deemed to be references to the plural and vice versa.

Any obligation on a party not to do something shall be deemed to include an obligation to take reasonable steps to prevent another party from so doing.

General

Your accessing or using the Site constitutes confirmation that you have read and agreed to these Terms of Use together with our Policies as well as other agreements that we may from time-to-time post on the Site.

In the case of Authorised Customers you represent that you have full authority to act when contracting business with us to bind yourself and/or any other relevant third party (whether corporate, personal or other legal entity) in connection with the relevant business being transacted.

Without prejudice to the preceding paragraph and by viewing, visiting, using, or interacting with the Site or with any banner, pop-up, or advertising that appears on it, you are deemed to have agreed to all the provisions of these Terms of Use including our Policies.

We reserve the right to deny access to any person or viewer for any lawful reason.  For the avoidance of doubt we are entitled under our Privacy Policy to collect and store data and information for the purpose of exclusion.

This terms of use may change from time to time.  Visitors and Authorised Customers have an affirmative duty to keep themselves informed of such changes by reviewing our Terms of Use each time they visit the Site.

Use of information from this website

Unless you have entered into an express written contract with us to the contrary, no Visitors or Authorised Customers or third parties have any right to use the information contained in the Site in a commercial or public setting; nor a right to broadcast it, copy it, save it, print it, sell it, or publish any portions of the content of the Site.

By accessing the contents of the Site you agree to this condition of access and you acknowledge that an unauthorised use will be deemed unlawful and may subject you to civil or criminal penalties.

For the avoidance of doubt your accessing or using the Site constitutes your acceptance of this provision within the Terms of Use.

Ownership of website or right to use, sell publish contents of this website

The Site and its contents are owned or licensed by the Site’s Owner.  The Visitors and Authorised Customers have no rights whatsoever in the content of the Site.  Use of the Site’s content for any reason is unlawful unless it is undertaken in connection with an express contract with or permission of us and/or the Website Owner.

Hyperlinking to site, co-branding, “framing” and referencing site prohibited

Unless expressly authorised by us, no one may hyperlink this site, or portions thereof, (including, but not limited to, logotypes, trademarks, branding or copyrighted material) to theirs for any reason.  Furthermore, you are not permitted to reference the URL (website address) of the Site or any page of the Site in any commercial or non-commercial media without express permission from us, nor are you allowed to ‘frame’ the site.  You specifically agree to cooperate with us so as to remove or de-activate any such activities.

You agree to keep us fully and effectually indemnified in respect of all losses, costs, claims, actions and demands whatsoever arising in connection with a breach of this provision.

Disclaimer for contents of site

Without prejudice to our General Disclaimer and Medical Disclaimer policies we disclaim any responsibility for the accuracy of the content appearing within, linked to or mentioned on within the Site.  Unless you have entered into an express contract to the contrary with us, you have no right to rely on any information contained herein as accurate with regard to which we make no representation or give any warranty.

Disclaimer for harm caused to your computer or software from interacting with this website or its contents. Visitor assumes all risk of viruses, worms, or other corrupting factors.

We assume no responsibility for damage to computers or software of Visitors or Authorised Customers or of any person they respectively subsequently communicate with due to corrupting code or data that is inadvertently passed to such parties’ computer.  Visitors and Authorised Customers view and interact with the Site, or banners or pop-ups or advertising displayed within it, at their own risk.

Disclaimer for harm caused by downloads

Visitors and Authorised Customers download information from the Site at his own risk.  We give no warranty that downloads are free of corrupting computer codes, including, but not limited to, viruses and worms.

Limitation of our liability

Visitors and Authorised Customers forever waive all rights to claim damages or other compensation of any and all description based on any causal factor resulting in any possible harm, no matter how heinous or extensive, whether physical or emotional, foreseeable or unforeseeable, whether personal or commercial in nature as a result of their use of the Site (including banners, advertising or pop-ups and downloads appearing within the Site).

Additionally, you agree not to hold us liable for any damages or loss of any kind related to issues beyond our control, including acts of God, war, terrorism, insurrection, riots, criminal activity, natural disasters, disruption of communications or infrastructure, labour shortages or disruptions (including unlawful strikes), shortages of materials, and any other events which are not within our control.

In the event of the Law prohibiting the requirement for waiving of compensation as above it is agreed that our maximum liability to you will not exceed the amount paid by you (if any) for utilising the Site and/or services provided by us.

Indemnification

The Visitors and Authorised Customers agree at all times to keep us fully and effectually indemnified in respect of all losses, costs, claims, actions and demands whatsoever arising as a result of the manner in which the Visitor and Authorised Customers make use of the Site.

Submissions

Visitor agrees as a condition of viewing, that any communication between Visitor and Website is deemed a submission.  All submissions, including portions thereof, graphics contained thereon, or any of the content of the submission, shall become the exclusive property of the Website and may be used, without further permission, for commercial use without additional consideration of any kind.  Visitor agrees to only communicate that information to the Website, which it wishes to forever allow the Website to use in any manner as it sees fit.  “Submissions” is also a provision of the Privacy Policy.

 

Disputes

In connection with your viewing, using or interacting with the Site, you agree to use binding arbitration for any claim, dispute, or controversy (“CLAIM”) of any kind (whether in contract, tort or otherwise) arising out of or relating to the utilisation as aforesaid of the Site including issues concerning privacy and terms of use.

The determination of liability for payment of costs and associated expenses relating to the relevant dispute shall be decided by the arbitrator as part of the arbitration process.

Applicable law

The interpretation of the content of the Site (including the Terms of Use and our Policies) shall be governed by the law of England and Wales.
